1. Account Eligibility & Licensing

To subscribe to and use Orlan AI, you must be a licensed real estate agent or broker in your state or country of operation. You are granted a limited, non-transferable, revocable license to use the conversational dashboard and listing remark engines. You are responsible for ensuring that all brokerage team members accessing your Enterprise workspace comply with these terms.

2. Business Line Allocation & Grace Period

Orlan AI provisions local business phone numbers via third-party telecom carriers (such as Twilio) to conduct SMS follow-ups.

• Line Ownership: All provisioned numbers remain the property of Orlan AI and its telecom providers. You are granted access to use the allocated line for active client qualification only during your paid subscription.
• 30-Day Retention Grace Period: In the event that you cancel your subscription or your card payment fails, we will retain your allocated local phone line in a paused state for exactly 30 days. After 30 days, the number will be released back to the general carrier pool and cannot be recovered.

3. Subscriber Consent & TCPA Duty

The Subscriber (the agent or brokerage) is the sole "sender" of all SMS text messages sent through Orlan AI.

You warrant that you have obtained prior express written consent from each prospect before enabling automated conversational routes or messaging them from the dashboard. You indemnify Orlan AI from any class actions, statutory fines, or legal penalties resulting from unsolicited texting.

4. SMS Messaging Program Terms

Program description: Orlan AI sends conversational SMS messages on behalf of licensed real estate agents to consumers who have submitted an inquiry about a property listing. Messages answer listing questions, qualify interest, and coordinate showings.

How consent is obtained: Consumers opt in by submitting an inquiry on a real estate listing (for example Zillow, Realtor.com, an agent website, or a lead form) where they provide their mobile number and agree to be contacted.

• Message frequency varies depending on your conversation activity.
• Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
• Text STOP to unsubscribe at any time. You will receive a confirmation and no further messages.

5. AI Output & Verification Responsibilities

Generative artificial intelligence models are prone to factual inaccuracies, errors, and "hallucinations." Orlan AI makes no guarantee of the validity, accuracy, or suitability of messages, emails, or property descriptions drafted by the AI.

Your Duty to Audit: You hold the sole, non-delegable responsibility to audit and verify all listing remarks, pricing quotes, showing appointments, and conversation transcripts generated by the AI before allowing them to be transmitted or relied upon.

6. Billing, Quotas, and Upgrades

Subscriptions are billed in advance on a recurring monthly cycle via Stripe.

• Plan Quotas: Monthly SMS quotas (Agent: 300, Pro: 900, Team: 4,000) do not roll over. If your monthly usage exceeds the quota, outbound texting features will be automatically paused until the next cycle unless you purchase an overflow pack or upgrade.
• Action on Plan Changes: Plan changes (upgrades or downgrades) will dynamically adjust your next billing invoice and quota limits in Stripe.
• Refunds: All payments are non-refundable.

7. Limitation of Liability

In no event shall Orlan AI, its founders, or affiliates be liable for any lost commissions, lost client contracts, regulatory TCPA fines, or consequential damages. If any liability is found, it is strictly capped at the total amount paid by you to Orlan AI in the twelve (12) months preceding the claim.
